{"id":729,"date":"2018-06-01T10:06:31","date_gmt":"2018-06-01T14:06:31","guid":{"rendered":"https:\/\/f2labs.com\/technotes\/?p=729"},"modified":"2025-03-18T14:13:10","modified_gmt":"2025-03-18T18:13:10","slug":"ce-marking-ambiguity","status":"publish","type":"post","link":"https:\/\/f2labs.com\/technotes\/2018\/06\/01\/ce-marking-ambiguity\/","title":{"rendered":"The Ambiguity of the CE Marking Process"},"content":{"rendered":"<p>Yesterday I posted an <a href=\"https:\/\/f2labs.com\/technotes\/2018\/05\/31\/the-low-voltage-directive-2014-35-eu-its-scope-and-products-that-operate-from-dc-voltage\/\" target=\"_blank\" rel=\"noopener\">article<\/a> pertaining to last week&#8217;s <a href=\"https:\/\/ec.europa.eu\/consumers\/consumers_safety\/safety_products\/rapex\/alerts\/?event=main.listNotifications\" target=\"_blank\" rel=\"noopener\">RAPEX report<\/a> and the scope of the <a href=\"https:\/\/f2labs.com\/low-voltage-directive-testing\" target=\"_blank\" rel=\"noopener\">Low Voltage Directive 2014\/35\/EU<\/a>. Today I reviewed this week&#8217;s &#8216;catch&#8217; of non-conforming products and it is a very illustrative of the opaqueness, sometimes, of the laws.<\/p>\n<p>As we demonstrated, the <a href=\"https:\/\/ec.europa.eu\/growth\/single-market\/european-standards\/harmonised-standards\/low-voltage_en\" target=\"_blank\" rel=\"noopener\">Low Voltage Directive 2014\/35\/EU<\/a> is applicable to products that operate with an input voltage of 50 to 1,000 VAC or 75 to 1,500 VDC. However, the EU drags other products into the scope as well. On November 1, 2016 the EU published a guideline document for the Low Voltage Directive 2014\/35\/EU, <a href=\"http:\/\/ec.europa.eu\/DocsRoom\/documents\/20341\">here<\/a>.<\/p>\n<p>On page 73 of that document exists a chart, in Annex VII, to give a reference for people trying to understand if a product is in or out of the scope.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-730\" src=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic1.jpg\" alt=\"\" width=\"957\" height=\"602\" srcset=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic1.jpg 957w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic1-300x189.jpg 300w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic1-768x483.jpg 768w\" sizes=\"auto, (max-width: 957px) 100vw, 957px\" \/><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-731\" src=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic2.jpg\" alt=\"\" width=\"902\" height=\"621\" srcset=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic2.jpg 902w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic2-300x207.jpg 300w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic2-768x529.jpg 768w\" sizes=\"auto, (max-width: 902px) 100vw, 902px\" \/><\/p>\n<p>If we zoom in, we can see that travel plug adapters are considered within the scope of the Directive.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-732\" src=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic3.jpg\" alt=\"\" width=\"895\" height=\"412\" srcset=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic3.jpg 895w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic3-300x138.jpg 300w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic3-768x354.jpg 768w\" sizes=\"auto, (max-width: 895px) 100vw, 895px\" \/><\/p>\n<p>So, it was with great interest that I saw this product, stopped in customs this week:<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-733\" src=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic4.jpg\" alt=\"\" width=\"947\" height=\"519\" srcset=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic4.jpg 947w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic4-300x164.jpg 300w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic4-768x421.jpg 768w\" sizes=\"auto, (max-width: 947px) 100vw, 947px\" \/><\/p>\n<p>Going in for an even closer look (at the <a href=\"https:\/\/ec.europa.eu\/consumers\/consumers_safety\/safety_products\/rapex\/alerts\/?event=main.notification&amp;search_term=A12\/0737\/18&amp;exclude_search_term=0&amp;search_year=2018\" target=\"_blank\" rel=\"noopener\">link<\/a>) I see that the product does carry a CE marking.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-734 size-full\" src=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic5.jpg\" alt=\"\" width=\"777\" height=\"654\" srcset=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic5.jpg 777w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic5-300x253.jpg 300w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic5-768x646.jpg 768w\" sizes=\"auto, (max-width: 777px) 100vw, 777px\" \/><\/p>\n<p>But, what is interesting, to me, is that the notification does not reference the CE marking or the Low Voltage Directive 2014\/35\/EU. It references non-compliance to a &#8216;national standard&#8217; which, in layman&#8217;s terms, means that the product does not comply with whatever standard is required in the importing country&#8230;. not that it does not comply with the Low Voltage Directive 2014\/35\/EU and the applicable harmonized EN standard, EN 62368-1.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-735\" src=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic6.jpg\" alt=\"\" width=\"737\" height=\"266\" srcset=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic6.jpg 737w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic6-300x108.jpg 300w\" sizes=\"auto, (max-width: 737px) 100vw, 737px\" \/><\/p>\n<p>And notice the last bullet point from the scope of EN 62368-1, below.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-736\" src=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic7.jpg\" alt=\"\" width=\"601\" height=\"286\" srcset=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic7.jpg 601w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic7-300x143.jpg 300w\" sizes=\"auto, (max-width: 601px) 100vw, 601px\" \/><\/p>\n<p>&#8220;<em><strong>accessories intended to be used with equipment within the scope of this part of IEC 62368<\/strong><\/em>&#8221;<\/p>\n<p>The travel adapter is within the scope of the Low Voltage Directive 2014\/35\/EU and is within the scope of EN 62368-1:2014&#8230; not, in our opinion, a national standard.<\/p>\n<p>This is a very important, critical distinction. To highlight this point, I reference section 4.1.2. from the <a href=\"http:\/\/ec.europa.eu\/DocsRoom\/documents\/18027\/\" target=\"_blank\" rel=\"noopener\">EU Blue Guide to Product Rules<\/a>:<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-737\" src=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic8.jpg\" alt=\"\" width=\"887\" height=\"263\" srcset=\"https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic8.jpg 887w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic8-300x89.jpg 300w, https:\/\/f2labs.com\/technotes\/wp-content\/uploads\/2018\/06\/LVD06012018_pic8-768x228.jpg 768w\" sizes=\"auto, (max-width: 887px) 100vw, 887px\" \/><\/p>\n<p>National standards and harmonised standards are different and it means a great deal for your compliance project.<\/p>\n<p>It can mean the difference between having your product seized in an EU customs border checkpoint or making its way to some store shelf or shelves all over the EU.<\/p>\n<div class=\"entry-content\">\n<p>Want some help to understand the nuances and ambiguity of CE marking and your EU project ?
